Compensation will now be paid out to patients with breast cancer who had been operated on by the disgraced British breast surgeon Ian Paterson, who was convicted in a criminal court in April 2017 of "wounding with intent," as reported at the time by Medscape Medical News.

The criminal court case involved a sample group of 10 patients who had been treated privately by the surgeon and had undergone unnecessary surgery (because they did not actually have breast cancer) or far more extensive surgery than had been warranted. In some of these cases, a biopsy instead of invasive surgery would have been more appropriate, the prosecution argued.

Patterson, who had been struck off the General Medical Council back in 2012, was sentenced to 15 years in jail, later upped to 20 years by the Appeal Court.

The 10 patients who testified at the criminal trial are just the tip of the iceberg.

They are part of a group of around 350 patients who had been treated by Paterson in his private practice. They are all now going to receive compensation, from a fund of ?37 million (approximately $45 million), the BBC reports. Much of this fund (?27.2 million) has come from the private firm, Spire Healthcare, that employed him at various small hospitals in the West Midlands, while the remaining ?10 million comes from Paterson's insurers and the Heart of England National Health Service (NHS) Trust.

That Trust has already paid out compensation to patients with breast cancer who had been treated by Paterson while he was working for the NHS as a consultant breast surgeon at the Solihull Hospital in Birmingham. In total, 256 patients whom Paterson operated on under the NHS have already received compensation, totaling nearly ?18 million in damages and legal costs.

The issue with these surgeries was somewhat different from that described in the criminal case.

In his NHS work, Paterson was performing "cleavage-sparing mastectomy," a technique that he had developed himself. It gave a good cosmetic result but in some cases left breast cancer tissue behind, putting the patients at an increased risk for relapse.

The NHS Trust stopped the cleavage-sparing mastectomies in 2007.

The Trust then suspended Paterson in May 2011 and at that time invited all patients who had undergone a mastectomy with him "to see an alternative surgeon for a review of their treatment and care." That notice also said that he had used a technique that "was not usual procedure." There were "justifiable concerns" that the cleavage-sparing technique was leaving patients at risk of relapse, the BBC reports.

The following year, in 2012, he was struck off the General Medical Council, and then the West Midlands police began investigating the cases of patients who had been treated in Paterson's private practice. This investigation led earlier this year to the criminal case that resulted in his being imprisoned.

Private Healthcare Company's Statement

In a statement, Spire Healthcare's interim chief executive, Simon Gordon, said, "Earlier this year a criminal court decided that Ian Paterson must bear responsibility for his actions, finding him guilty of assaulting a number of his patients.

"He behaved with clear criminal intent and abused the trust of those who looked to him for his care and relied upon his expertise.
"However, whilst nothing diminishes Mr Paterson's responsibility for his actions, these events took place in our hospitals, and this should not have happened.

Tampa, FL – Dr. James Norman, the owner and operator of James Norman, MD, PA, a/k/a James Norman, MD, PA Parathyroid Center, d/b/a Norman Parathyroid Center (collectively, Norman) has agreed to pay $4 million to resolve allegations that he violated the False Claims Act by knowingly engaging in various unlawful billing practices with respect to Medicare and other federal health care programs and their beneficiaries.

Specifically, the government alleges that, from April 2008 through December 2016, Dr. Norman submitted fraudulent claims to Medicare, TRICARE, and the Federal Employee Health Benefits Program for pre-operative examinations performed on the day before or the day of surgery, and charged and collected extra fees from federal health care beneficiaries for services for which he had already received payment from the government. These extra fees ranged from $150 to $750 for Florida residents, to $1,750 or more for patients who lived out-of-state. Collectively, Dr. Norman and his practice pocketed hundreds of thousands of dollars as a result of these illicit billing practices.

“Fraudulent billing of the government, while also charging Medicare and other federal health care beneficiaries extra fees for services that the government has already paid for victimizes taxpayers, military veterans, the elderly, and other members of our community, and will not be tolerated,” said Acting U.S. Attorney Muldrow. “This lawsuit and today’s settlement demonstrates our office’s ongoing efforts to safeguard federal health care program beneficiaries from the effects of such illegal conduct.”

In addition to paying $4 million, Norman has also agreed to enter into an integrity agreement with the Inspector General of the U.S. Department of Health and Human Services.

“Physicians who systematically overbill Federal health care programs and their vulnerable patients will be held responsible for this fraudulent behavior,” said Special Agent in Charge Shimon R. Richmond of HHS-OIG. “Those who engage in such schemes can expect a thorough investigation and strong remedial measures such as those in the Integrity Agreement we signed with Dr. Norman.”

The settlement concludes a lawsuit originally filed by a former patient of Dr. Norman, Myra Gross, and her husband, Dr. David Gross, in the United States District Court for the Middle District of Florida. The lawsuit was filed under the qui tam, or whistleblower, provisions of the False Claims Act, which permit private individuals to sue on behalf of the government for false claims and to share in any recovery. Act also allows the government to intervene and take over the action, as it did in this case. Ms. Gross and her husband, Dr. Gross, will receive roughly $600,000 of the proceeds from the settlement with Norman.

The government’s action in this matter illustrates the government’s emphasis on combating health care fraud. One of the most powerful tools in this effort is the False Claims Act. Tips from all sources about potential fraud, waste, abuse, and mismanagement can be reported to the Department of Health and Human Services, at 800-HHS-TIPS (800-447-8477).

The settlement was the result of a coordinated effort by the U.S. Attorney’s Office for the Middle District of Florida and the U.S. Department of Health and Human Services – Office of Inspector General. It was handled Assistant U.S. Attorney Christopher Tuite.

The case is captioned United States ex rel. Gross, et al. v. James Norman, MD, PA, et al., Case No. 8:14-cv-978-T-33EAJ. The settlement resolves the United States’ claims in that case. The claims resolved by the settlement are allegations only, and there has been no determination of liability.

Да, неукам вроде меня с транслейтом полегче. Однако, формулировка"...злоупотреблял доверием тех, кто обращался к нему за его заботой и полагался на его опыт" пугает вне контекста: я так всю жизнь злоупотребляю. Вот лечу я даму 123 кг с гонартрозом, СД и постфлебитическим синдромом - ведь ни за что не вылечу. И на ТЭКС ее никто не возьмет. В тюрягу собираться?

Наталья, у Рындина особая зависть и ревность к Давыдову, можно сказать, патологическая. Онкомафию нельзя путать с хирургией. Давыдов - хирург-виртуоз. Я только однажды видел, как он оперирует. Но этого было достаточно для того, чтобы я понял, что равных ему, из всех, кого мне довелось видеть, нет.

в настоящее время в Москве проходит 21 онкоконгресс. 14.11.17 г слушал вступительное выступление Давыдова. Страшно становится - вся онкологическая помощь, включая все онкологические операции, должны выполняться в центральных специализированных онкологических учреждениях. Не перегиб ли это?
